Section 1
Electoral Board
(1) Die Leitung der Wahl obliegt dem (1) The electoral board is responsible for

dem Vorsitzenden und einem weiteren
stimmberechtigten

(3) The decisions of the electoral board are
to be adopted with simple majority of the
voting board members. The meetings of the
electoral board are to be held as in-person
meetings. Minutes must be taken of every
meeting of the electoral board, including at
least the wording of all decisions adopted.
The minutes must be signed by the
chairperson and one other voting member of
the electoral board.
(4) Abweichend von Absatz 3 Satz 2 kann der

It must be ensured, that no third party can
obtain access to the meeting’s content. A
recording of the meeting is unlawful. The
ones attending by video and telephone
conference confirm their attendance to the
chairperson in text form. The confirmation
must be attached to the minutes according
to Subsection (3).
(5) Erfolgt die Sitzung des Wahlvorstands mit
der zusätzlichen Möglichkeit der Teilnahme
mittels Video- und Telefonkonferenz, gilt
auch eine Teilnahme vor Ort als erforderlich.
(5) If the meeting of the electoral board
takes place with the additional possibility of
attendance by video and telephone
conference, an in-person attendance as well
applies as necessary.
§2
Wählerliste
Section 2
Voter list
(1) Der Wahlvorstand hat für jede
Betriebsratswahl
eine
Liste
der
Wahlberechtigten (Wählerliste), getrennt
nach den Geschlechtern, aufzustellen. Die
Wahlberechtigten sollen mit Familienname,
Vorname
und
Geburtsdatum
in
alphabetischer Reihenfolge aufgeführt
werden. Die nach Absatz 3 Satz 2 nicht passiv
Wahlberechtigten sind in der Wählerliste
auszuweisen.
(1) For every election to the works council
the electoral board must set up a list of the
electors (voter list), separated by gender.
The electors shall be listed by last name, first
name and date of birth in alphabetical order.
The persons without the right to stand for
election according to Subsection (3)
Sentence 2 must be identified in the voter
list.

(2) Der Arbeitgeber hat dem Wahlvorstand
alle für die Anfertigung der Wählerliste
erforderlichen Auskünfte zu erteilen und die
erforderlichen Unterlagen zur Verfügung zu
stellen. Er hat den Wahlvorstand
insbesondere bei Feststellung der in § 5 Abs.
3 des Gesetzes genannten Personen zu
unterstützen.
(2) The employer must provide the electoral
board with all informations necessary for
setting up the voter list and must provide all
necessary documents. He must support the
electoral board in particular with the
ascertainment of the persons namend in
Section 5 Subsection (3) of the Act.
(3) Das aktive und passive Wahlrecht steht
nur Arbeitnehmerinnen und Arbeitnehmern
zu, die in die Wählerliste eingetragen sind.
Wahlberechtigten Arbeitnehmerinnen und
Arbeitnehmern, die am Wahltag nicht nach
§ 8 des Gesetzes wählbar sind, und
wahlberechtigten Leiharbeitnehmerinnen
und Leiharbeitnehmern (§ 14 Absatz 2 Satz 1
des
Arbeitnehmerüberlassungsgesetzes)
steht nur das aktive Wahlrecht zu.
(3) Only employees listed in the voter list
have the right to vote and the right to stand
for election. Employee electors, who do not
have the right to stand for election in
accordance to Section 8 of the Act on
election day, as well as temporary agency
worker electors (Section 14 Subsection (2)
Sentence 1 of the Act on Temporary Agency
Work), only have the right to vote.
(4) Ein Abdruck der Wählerliste und ein
Abdruck dieser Verordnung sind vom Tage
der Einleitung der Wahl (§ 3 Abs. 1) bis zum
Abschluss der Stimmabgabe an geeigneter
Stelle im Betrieb zur Einsichtnahme
auszulegen. Der Abdruck der Wählerliste soll
die Geburtsdaten der Wahlberechtigten
nicht enthalten. Ergänzend können der
Abdruck der Wählerliste und die Verordnung
mittels der im Betrieb vorhandenen
Informations- und Kommunikationstechnik
bekannt
gemacht
werden.
Die
Bekanntmachung
ausschließlich
in
elektronischer Form ist nur zulässig, wenn
alle Arbeitnehmerinnen und Arbeitnehmer
von der Bekanntmachung Kenntnis erlangen
können und Vorkehrungen getroffen
werden,
dass
Änderungen
der
Bekanntmachung nur vom Wahlvorstand
vorgenommen werden können.
(4) A reprint of the voter list and a reprint of
this regulation must be put on display for
inspection at an adequate location in the
establishment beginning the day the
election is started (Section 3 Subsection (1))
until voting is closed. The reprint of the voter
list shall not list the dates of birth of the
electors. Additionaly the reprint of the voter
list and the regulation can be announced by
means of in the establishment existing
information and communicaton technology.
The announcement in electronic form only is
legal, if all employees can obtain knowledge
of the announcement and precautionary
measures are put in place, so that changes of
the announcement can only be carried out
by the electoral board.
(5) Der Wahlvorstand soll dafür sorgen, dass
ausländische
Arbeitnehmerinnen

Arbeitnehmer, die der deutschen Sprache
nicht mächtig sind, vor Einleitung der
Betriebsratswahl über Wahlverfahren,

Wahlausschreiben
Section 3
Letter to announce the start of the election
season
(1) Spätestens sechs Wochen vor dem ersten
Tag der Stimmabgabe erlässt der
Wahlvorstand ein Wahlausschreiben, das
von der oder dem Vorsitzenden und von
mindestens
einem
weiteren
stimmberechtigten
Mitglied
des
Wahlvorstands zu unterschreiben ist. Mit
Erlass des Wahlausschreibens ist die
Betriebsratswahl eingeleitet. Der erste Tag
der Stimmabgabe soll spätestens eine
Woche vor dem Tag liegen, an dem die
Amtszeit des Betriebsrats abläuft.
(1) At the latest six weeks before the first day
of voting the electoral board issues a letter
announcing the start of the election season,
that is signed by the chairperson and at least
one more voting member of the electoral
board. With issueing the letter announcing
the start of the election season, the election
to the works council is initiated. The first day
of voting shall be at the latest one week
before the day, on which the tenure of the
works council ends.

(3) Sofern es nach Größe, Eigenart oder
Zusammensetzung der Arbeitnehmerschaft
des Betriebs zweckmäßig ist, soll der
Wahlvorstand im Wahlausschreiben darauf
hinweisen, dass bei der Aufstellung von
Wahlvorschlägen
die
einzelnen
Organisationsbereiche
und
die
verschiedenen
Beschäftigungsarten
berücksichtigt werden sollen.
(3) if in respect to the size, characteristics or
composition of the work force of the
establishment it is practical, the electoral
board shall inform in the letter announcing
the start of the election season, that for
setting up nominations the individual
organizational units and the different
employment categories shall be taken into
account.
(4) Ein Abdruck des Wahlausschreibens ist
vom Tage seines Erlasses bis zum letzten
Tage der Stimmabgabe an einer oder
mehreren
geeigneten,
den
Wahlberechtigten zugänglichen Stellen vom
Wahlvorstand auszuhängen und in gut
lesbarem Zustand zu erhalten. Ergänzend
kann das Wahlausschreiben mittels der im
Betrieb vorhandenen Informations- und
Kommunikationstechnik bekannt gemacht
werden. § 2 Abs. 4 Satz 4 gilt entsprechend.
Ergänzend hat der Wahlvorstand das
Wahlausschreiben den Personen nach § 24
Absatz 2 postalisch oder elektronisch zu
übermitteln; der Arbeitgeber hat dem

Einspruch gegen die Wählerliste

Appeal against the voter list
(1) Einsprüche gegen die Richtigkeit der
Wählerliste können mit Wirksamkeit für die
Betriebsratswahl nur vor Ablauf von zwei
Wochen seit Erlass des Wahlausschreibens
beim Wahlvorstand schriftlich eingelegt
werden.
(1) Appeals against the correctness of the
voter list can be submitted with validaty for
the election to the works council only within
two weeks to the electoral board in writing
since issueing the letter announcing the start
of the election season.
(2) Über Einsprüche nach Absatz 1 hat der
Wahlvorstand unverzüglich zu entscheiden.
Der Einspruch ist ausgeschlossen, soweit er
darauf gestützt wird, dass die Zuordnung
nach § 18a des Gesetzes fehlerhaft erfolgt
sei. Satz 2 gilt nicht, soweit die nach § 18a
Abs. 1 oder 4 Satz 1 und 2 des Gesetzes am
Zuordnungsverfahren
Beteiligten
die
Zuordnung
übereinstimmend
für
offensichtlich fehlerhaft halten. Wird der
Einspruch für begründet erachtet, so ist die
Wählerliste zu berichtigen. Die Entscheidung
des Wahlvorstands ist der Arbeitnehmerin

Einspruch eingelegt hat, unverzüglich
schriftlich mitzuteilen; die Entscheidung
muss der Arbeitnehmerin oder dem
Arbeitnehmer spätestens am Tage vor dem

Verhältnis im Betrieb in der Minderheit ist.
Sodann errechnet der Wahlvorstand den
Mindestanteil der Betriebsratssitze für das
Geschlecht in der Minderheit (§ 15 Abs. 2
des Gesetzes) nach den Grundsätzen der
Verhältniswahl. Zu diesem Zweck werden
die Zahlen der am Tage des Erlasses des
Wahlausschreibens im Betrieb beschäftigten
Frauen und Männer in einer Reihe
nebeneinander gestellt und beide durch 1, 2,
3, 4 usw. geteilt. Die ermittelten Teilzahlen
sind nacheinander reihenweise unter den
Zahlen der ersten Reihe aufzuführen, bis
höhere Teilzahlen für die Zuweisung der zu
verteilenden Sitze nicht mehr in Betracht

Wahlverfahrens vereinbart worden ist (§ 14a

sind von den Wahlberechtigten vor Ablauf
von zwei Wochen seit Erlass des
Wahlausschreibens beim Wahlvorstand

stimmberechtigten
Mitglied
des
Wahlvorstands zu unterschreiben ist. Mit
Erlass des Wahlausschreibens ist die
Betriebsratswahl
eingeleitet.
Das
Wahlausschreiben muss folgende Angaben
enthalten:

und faltet ihn in der Weise, dass ihre oder
seine Stimme nicht erkennbar ist; es dürfen
nicht mehr Bewerberinnen oder Bewerber
angekreuzt
werden,

Abs. 1 Satz 2, Abs. 2 Satz 2, Abs. 4 und § 12
gelten entsprechend.

electoral board tallies the votes in public and
declares the election result produced by the
tallying. Sections 21, 23 Subsection (1) apply

person refuses to accept the election, the
person is displaced by the not elected person
with the next-highest number of votes.

schriftliche Stimmabgabe beantragen (§ 14a
Abs. 4 des Gesetzes). Das Verlangen auf
nachträgliche schriftliche Stimmabgabe
muss die oder der Wahlberechtigte dem
Wahlvorstand spätestens drei Tage vor dem

Stimmzetteln auch der Ausbildungsberuf der
einzelnen Bewerberinnen oder Bewerber
aufzuführen ist. § 38 Satz 2 gilt
entsprechend.
